Terms of Service

These Terms of Service (the "Terms") govern your access to and use of mayaocean.com (the "Site") operated by Maya Ocean Real Estate S.A. de C.V. ("Maya Ocean", "we", "our", or "us"). By accessing or using the Site you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About our service

Maya Ocean is a licensed real-estate broker that aggregates and presents information about properties and developments in the Riviera Maya region. Through the Site you can browse verified listings, request information, and book consultations with our team.

Maya Ocean is a broker, not the owner or developer of the properties advertised on the Site. We connect prospective buyers with verified developments and their authorised sellers. We do not sell property directly; any purchase contract is executed between you and the owner, developer, or other authorised seller, with Maya Ocean acting in a brokerage capacity.

2. Eligibility

You must be at least eighteen (18) years old and legally able to enter into a binding contract to use the Site. By using the Site you represent that you meet these requirements.

3. Information accuracy and no warranty

The Site, including listings, prices, availability, floor plans, images, inventory, delivery dates, amenities, taxes, fees, and descriptions, is provided on an "as is" and "as available" basis without warranty of any kind, whether express, implied, statutory, or otherwise, to the maximum extent permitted by law.

Specifically, you acknowledge that:

• Prices, availability, and inventory change frequently and may not be up to date at the moment you view a listing.
• Photographs, renderings, and virtual tours are for illustration only and may differ from the final property delivered by the developer.
• Square-footage figures, layouts, finishes, amenities, and HOA fees are supplied by developers and owners and may be revised.
• Returns, appreciation, and rental yields shown anywhere on the Site are historical or projected estimates, not guarantees of future performance, and do not constitute investment, legal, or tax advice.
• You are responsible for independently verifying any information that is material to your purchasing decision and for engaging your own legal, financial, and tax advisors.

4. Lead forms and communications

When you submit a form on the Site you confirm that the information you provide is true and that you authorise Maya Ocean to contact you about your request. For requests tied to a specific property or development you also authorise us to forward your contact details to the relevant developer or seller so they can respond.

Our use of the information you submit is governed by our Privacy Policy.

5. Intellectual property

The Site, including its design, code, text, graphics, logos, the "Maya Ocean" name, editorial content, and the selection and arrangement of listings, is owned by Maya Ocean or its licensors and is protected by Mexican and international copyright, trademark, and other intellectual property laws. Listing data including photographs, renderings, floor plans, descriptions, and pricing is licensed to Maya Ocean by the respective developers, owners, or authorised representatives.

We grant you a limited, non-exclusive, non-transferable, revocable licence to view the Site for your personal, non-commercial use and for the purpose of evaluating real-estate opportunities. All other rights are reserved.

6. User obligations and prohibited conduct

When you use the Site you agree not to:

• Scrape, crawl, harvest, index, or otherwise extract data from the Site by automated means in a manner that exceeds what is allowed by our robots.txt file or that would impose an unreasonable load on our infrastructure.
• Send automated requests, queries, or form submissions, or use bots, scripts, or other tools to interact with the Site, except where we explicitly authorise such access in writing.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Site.
• Use any of our contact details, lead-form responses, or developer contact information for unsolicited commercial communications, spam, or any unlawful purpose.
• Republish, sell, rent, sublicense, or otherwise commercially exploit any content from the Site without our prior written consent.
• Frame, mirror, or deep-link the Site in a way that misleads users about the source of the content.
• Upload or transmit viruses, malware, or any code designed to interrupt, destroy, or limit the functionality of any computer system.
• Use the Site in a way that violates any applicable law or regulation, including consumer-protection, anti-money-laundering, sanctions, and data-protection laws.

7. Third-party links and content

The Site may link to third-party websites, services, or content, including developer pages, mapping services, and social networks. We do not control those third parties and we are not responsible for their content, products, practices, or policies. Your dealings with any third party are solely between you and that third party.

8. Disclaimer of warranties

To the maximum extent permitted by law, Maya Ocean disclaims all warranties, express or implied, in connection with the Site and your use of it, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

9. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Maya Ocean, its affiliates, officers, directors, employees, brokers, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of or inability to use the Site, your reliance on any listing or information published on the Site, or any transaction entered into with a developer or seller, even if we have been advised of the possibility of such damages.

Where liability cannot be excluded under applicable law, our aggregate liability to you for all claims arising out of or in connection with these Terms or the Site is limited to one hundred US dollars (USD 100.00). Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law, including liability for fraud or for death or personal injury caused by negligence.

10. Indemnification

You agree to indemnify, defend, and hold harmless Maya Ocean and its affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

11. Suspension and termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have violated these Terms or if we need to do so to protect the Site or other users. Sections that by their nature should survive termination (including intellectual property, disclaimer of warranties, limitation of liability, indemnification, and governing law) will continue to apply after termination.

12. Modifications

We may modify these Terms at any time by posting the revised version on the Site and updating the "Last updated" date. Material changes will be announced through a notice on the Site. Your continued use of the Site after the changes take effect constitutes acceptance of the revised Terms.

13. Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them or the Site are governed by the laws of the United Mexican States and the state of Quintana Roo, without regard to conflict-of-law principles. The parties expressly submit to the exclusive jurisdiction of the competent courts of Playa del Carmen, Quintana Roo, Mexico, waiving any other jurisdiction to which they might be entitled by reason of their present or future domicile.

14. Dispute resolution

Before initiating any judicial proceeding, the parties agree to attempt in good faith to resolve any dispute by direct negotiation for a period of thirty (30) days from the date one party notifies the other in writing of the dispute. Disputes that remain unresolved after that period may be submitted to the competent courts identified above. Consumers may also avail themselves of the dispute-resolution mechanisms offered by the Federal Consumer Protection Agency (PROFECO) where applicable.

15. Severability and waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision.

16. Entire agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Maya Ocean regarding your use of the Site and supersede any prior agreements between you and Maya Ocean on that subject.
